These Terms of Use (the “Terms”) govern your use of and access to www.kimwensel.com and its sub-domains and affiliated sites, as well as Kimberly Wensel LLC’s (“Kimberly Wensel LLC” or “my”) pages and accounts on Instagram®, Threads®, LinkedIn®, Google®, and YouTube® (the “Sites”). Please read both these Terms and our Privacy Policy carefully, which is incorporated into these Terms. By using any or all of the Sites, you accept and agree to be bound by these Terms. If you do not want to agree to be bound by these Terms, do not use the Sites. We may modify these Terms from time to time, and any modifications will be effective immediately when we post them. All changes we make will be reflected in the date at the top of the document. You are responsible for reviewing any modified terms. Your continued use of a Site following any changes means you accept and agree to any changes. For your convenience and future reference, the date of the most recent revision of these Terms is listed above so that you may compare different versions to determine what, if any, changes have been made.
SITE CONTENT
Kimberly Wensel LLC exclusively owns and controls the Sites, which provide information about our products and services and may, from time to time, provide access to educational materials pertaining to a variety of topics about personal branding, brand development, messaging, writing, personal development, and creativity. You agree that use or access to any or all of the Sites does not, standing alone, create any sort of representation or future promise. The unauthorized reproduction, use of, or theft of any content, written, photographic, or otherwise, is expressly prohibited. By using the Sites, you expressly agree to pay a fine of $100 per incident for any unauthorized use of our content, at the sole discretion of Kimberly Wensel LLC.
INTELLECTUAL PROPERTY
Unless explicitly stated otherwise, as between you and Kimberly Wensel LLC, Kimberly Wensel LLC owns all right, title, and interest in and to the Sites, including, without limitation, graphics, site content, design, educational tools, organization, compilation and other matters related to or included on the Sites. Kimberly Wensel LLC and all related names, product and service names, logos, slogans, and designs are our trademarks and you may not use these marks without our prior written permission. All other names, logos, product and service names, designs and slogans on the Sites are the trademarks of their respective owners and should not be used without those respective owners’ permission. You are granted a non-exclusive, non-transferable, revocable license to access and use the Sites and the resources available for download from the Website strictly in accordance with these Terms.
THIRD PARTY RIGHTS
Content and materials posted to the Site may be the copyrighted content of others (“Third Party Content”) that is used by Kimberly Wensel LLC either by permission or under Section 107 of the Copyright Act as “fair use” for purposes such as education and research. We respect the intellectual property of others and ask that you do the same. Users must obtain permission from the owners of any Third-Party Content before copying, distributing or otherwise using those materials. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material will be permitted without the express permission of the copyright owner.

LINKING TO OUR SITES
Anyone linking to the Sites must comply with all applicable laws and must not: (i) misrepresent its relationship with Kimberly Wensel LLC; (ii) present false or misleading information about Kimberly Wensel LLC; or (iii) contain content that is reasonably considered profanity, offensive, defamatory, vulgar, or unlawful.

We may at times include advertisements on the Sites. CHOICE OF LAW AND VENUE
These Terms are governed by the laws of the Commonwealth of Pennsylvania without regard to any conflict of laws. For any dispute regarding these Terms or the Sites, you agree to submit to the personal and exclusive jurisdiction and venue of the federal and state courts located in Pittsburgh, Pennsylvania.

We use regular Malware Scanning.

COPPA (Children Online Privacy Protection Act)
When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of 13 years old.

California Online Privacy Protection Act
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CalOPPA, we agree to the following: Users can visit our site anonymously. Once this privacy policy is created, we will add a link to it on our home page or as a minimum, on the first significant page after entering our website. Our Privacy Policy link includes the word ‘Privacy’ and can be easily be found on the page specified above. You will be notified of any Privacy Policy changes on our Privacy Policy Page. You can change your personal information by emailing us.
Google
Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. https://support.google.com/adwordspolicy/answer/1316548?hl=en. We have not enabled Google AdSense on our site but we may do so in the future.
Fair Information Practices
The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information. In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur: we will notify you via email within 7 business days. We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.
CAN SPAM Act
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. We collect your email address in order to send information, respond to inquiries, and/or other requests or questions and to market to our mailing list or continue to send emails to our clients after the original transaction has occurred. To be in accordance with CANSPAM, we agree to the following: not use false or misleading subjects or email addresses, identify the message as an advertisement in some reasonable way; include the physical address of our business or site headquarters; monitor third-party email marketing services for compliance, if one is used; honor opt-out/unsubscribe requests quickly; allow users to unsubscribe by using the link at the bottom of each email. If at any time you would like to unsubscribe from receiving future emails, follow the instructions at the bottom of each email and we will promptly remove you from ALL correspondence.
